There are various class of child visas provided by the Australian migration law. These visas allow the parents who are Australian citizens, Permanent residents, or eligible New Zealand citizens to sponsor their children or adopted child to Australian on permanent basis. According to the circumstance of a child, following visa subclass can be applied:

Child visa (Subclass 101)

The applicant must be outside Australia

Adoption visa (Subclass 102)

The applicant must be outside Australia

The applicant must be in Australia

  1. Child Visa (Subclass 101)

To make an application for Child visa (Subclass 101):

  • be a dependent child of a parent who is an Australian citizen, eligible New Zealand citizen or holder of an Australian permanent visa
  • be under 18 years, a full-time student aged over 18 and under 25 and financially dependent on the parent, or over 18 and unable to work due to a disability
  • be single and dependent on the parent
  • be outside Australia when the application is made.

With this visa the child can

  • stay in Australia indefinitely.
  • work and study in Australia.
  • enrol Australia’s public healthcare scheme Medicare.
  • sponsor relatives to come to Australia.
  • apply for Australian citizenship, if eligible.

 

  1. Adoption Visa (Subclass 102)

To make an application for Adoption visa (Subclass 102):

  • have been under 18 years of age when adopted, when they apply and when the department make a decision
  • be outside Australia when the application is made and when the department make a decision
  • be adopted or in the process of being adopted by their sponsor parent.

With this visa the child can

  • stay in Australia indefinitely with their adoptive parent.
  • work and study in Australia.
  • enrol in Australia’s public healthcare scheme, Medicare.
  • sponsor their relatives to come to Australia.
  • apply for Australian citizenship, if eligible.

  1. Child Visa (Subclass 802)

To make an application for Child visa (Subclass 802), the child must:

  • be a dependent child of a parent who is an Australian citizen, eligible New Zealand citizen or holder of an Australian permanent visa.
  • be under 18 years, a full-time student aged over 18 and under 25, or over 18 and unable to work due to a disability.
